Section I: State Health Department rules adopted
Pursuant to Minnesota Statutes 145A.01 - 145A.11, 144.1222 (Abigail Taylor Pool Safety Act), 375.51 - 375.55 and Minnesota 4717.0150 – 4717.3970, except 4717.0450 relating to public swimming pools, including all subsequent amendments thereto, are adopted by Hennepin County by reference. Reference 4717.0150 –4717.3970, except 4717.0450 to Board or Board of Health shall be to the Hennepin County Board of Commissioners or their authorized representatives.
Section II: Definitions
For the purpose of this ordinance the following words shall have the following meaning:
Subsection 1 "County"
"County" shall mean Hennepin County.
Subsection 2 "Health authority"
"Health Authority" shall mean the Hennepin County Human Services and Public Health Department, and its designated employees, agents, or contractors, as the Hennepin County Board may designate.
Section III: License required
It is unlawful for any person to operate or permit swimming in a public swimming pool, regardless of whether a fee is charged for such use, unless Hennepin County has issued a valid license therefore which is in full force and effect. Licensing of swimming pools shall be pursuant to Hennepin County Ordinance No. 1. Where a property has more than one pool located upon it, a separate license shall be obtained for each pool. Only a person who complies with the provision of this ordinance and ordinances applicable thereto of the city or cities in which the public swimming pool is located shall be entitled to receive a license.
Section IV: License fees
Fees for licenses issued hereunder shall be those established from time to time by resolution of the County Board of Commissioners.
Section V: License expiration and renewal
Licenses issued pursuant to this ordinance expire on the last day of March each year. License renewal applications shall be filed with the County Board prior to April 1, of each year.
Section VI: Inspection of public swimming pools
The Health Authority shall inspect every public swimming pool as frequently as they may deem necessary to ensure compliance with this ordinance.
Section VII: Construction and plan review
All persons who construct or remodel a public swimming pool must first submit their plans and specifications to the Pool Engineer at the Office of the Minnesota Department of Health. If the Minnesota Department of Health does not require a plan review, its owner shall submit the plans to the Office of the Health Authority. The statutory or home rule charter city shall not issue a building permit for the facility or remodeling or alteration permit for the facility until such plans have the appropriate approvals. The swimming pool shall be constructed and finished in conformance with the approved plans. Inspections of the swimming pool will occur as frequently as the appropriate agency deems necessary during the construction or remodeling activities. They shall conduct a final inspection prior to the start of operations and issuance of an approved license.
Section VIII: Penalty
Any person violating a provision of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished pursuant to Hennepin County Ordinance No. 1.

Section IX: Separability
If any provision or application of any provision of this Ordinance is held invalid, that invalidity shall not affect other provisions or applications of this Ordinance.

Section XI: Effective date
After passage by the Hennepin County Board of Commissioners, this Ordinance shall be effective on November 15, 2022.
